X2 visa: staying within the duration of stay

An X2 holder may stay in China for the duration of stay written in the visa. Article 36(3) of the Regulations on Administration of the Entry and Exit of Foreigners (State Council Decree No. 637, "the Regulations") defines that duration as the period a visa holder is allowed to stay after each entry, beginning the next day after entry. The visa categories are described on X1 or X2.

What the duration of stay is

Article 36(3) of the Regulations says the duration of stay specified in the visa "means the period of time during which the visa holder is allowed to stay in China after each entry. It begins from the next day of entry."

Article 36(4) defines short-term as staying in China for a period not exceeding 180 days, including 180 days. Article 36(5) defines long-term or resident as residing in China for a period exceeding 180 days. Article 36 gives these meanings "in these Regulations."

Article 36(3) and Article 14 of the Regulations refer to visa holders in general and name no visa category. Article 29 of the Exit and Entry Administration Law (the Law) refers to "a foreigner" and names no visa category either. The number of days for an X2 holder is therefore the number written in the visa itself.

The 180-day rule in the Law

The first paragraph of Article 29 of the Law covers visas whose duration of stay does not exceed 180 days. It says that where that duration does not exceed 180 days, "the holder may stay in China within the duration specified therein."

The first paragraph of Article 29 contains no rule for a duration above 180 days.

How to apply for an extension

The second paragraph of Article 29 of the Law sets out the steps for an extension.

  1. File an application seven days prior to the expiry of the duration specified in the visa.
  2. File it with the exit and entry administration of the public security organ under the local people's government at or above the county level, in the place of stay.
  3. Submit information on the specific application matters in accordance with relevant requirements.

If, on examination, the reasons for extension are appropriate and sufficient, the extension shall be granted. If an extension is denied, the foreigner shall leave China on the expiry of the duration.

The total extension limit

The third paragraph of Article 29 of the Law says: "The accumulated length of extension shall not exceed the original duration of stay specified in the visa."

Article 14 of the Regulations states the same limit: the total period of extension "shall not exceed the original duration of stay specified in the visa."

What an extension changes and what it does not

Article 14 of the Regulations has two paragraphs. The first says the decision to extend the duration of stay "is only valid for the current entry and does not affect the number of entries or the validity period of the entry specified in the visa." The second says that when the duration of stay is extended, "a foreigner shall adhere to the purpose specified in the original visa and stay within the extended duration of stay."

What the Chinese Embassy in the United Kingdom says

The embassy's FAQ is a set of answers published by the Embassy of the People's Republic of China in the United Kingdom. The answers below are that embassy's own statements. They are not rules that apply to all Chinese missions.

Question 11 of the embassy's FAQ says that "Duration of Each Stay" refers to "the maximum number of days you are permitted to stay in China after each entry." It says that a holder of an ordinary visa who needs to stay longer after arrival must apply for an extension at the local public security authorities before the duration of stay runs out. It also says that overstaying the period a visa permits "is a breach of Chinese laws and regulations" and that the holder "may face fines or other penalties."

Question 12 of the embassy's FAQ says that foreign citizens must abide by the laws and regulations of the People's Republic of China while in China. It says they must not engage in activities other than the purpose stated in the visa application form, or in activities requiring approval from the Chinese government authorities. It also says that a foreign citizen who seeks to work in China needs a work permit.

How many days may an X2 holder stay in China?

The sources cited here give no day count for the X2 visa. Article 36(3) of the Regulations ties the duration of stay to the period specified in the visa, so the number of days is the one written in that visa.

Can an extension make the total stay longer than the visa's original duration?

No. The third paragraph of Article 29 of the Law says the accumulated length of extension shall not exceed the original duration of stay specified in the visa. Article 14 of the Regulations sets the same limit.
