Visa interview and fingerprints: when a language student may be asked
A language student may be asked to attend an interview, but only when the visa authority abroad finds one of the circumstances in Article 8 of the Regulations on Administration of the Entry and Exit of Foreigners (State Council Decree No. 637). Article 8 names no study purpose, and its fourth item covers "other circumstances where an interview is necessary" without defining them. For how the visa itself is classed, see X1 or X2.
What Article 8 says
Article 8 of the Regulations says that in one of the following circumstances, a foreigner shall be interviewed as required by the visa authority abroad:
- The applicant applies for entry into China for residence.
- Information about the applicant's personal identity or purpose of entry requires further verification.
- The applicant has a record of being denied entry into China or ordered to exit China within the prescribed time limit.
- Other circumstances where an interview is necessary.
Article 8 adds that where the visa authority abroad asks relevant departments or entities in China to help verify information, the latter shall cooperate.
What the UK embassy FAQ says
Q18 of the FAQ on the website of the Embassy of the People's Republic of China in the United Kingdom states that consular officers may interview applicants if necessary. This is that embassy's own statement. It is not a rule for all missions.
Fingerprints
The same Q18 says that Chinese laws and regulations require the collection of 10 fingerprints from each applicant at the Visa Center or the Embassy/Consulates-General. The FAQ lists two groups who can be exempted:
- Persons under the age of 14 or over the age of 70.
- Persons with injuries on all ten fingers, or in other situations where fingerprints cannot be collected.
Q18 also says that some diplomatic, service and courtesy visa applicants are exempted from the biometric requirement, and refers the reader to its section on those visas.
What the two texts do not settle
Article 8 names no study purpose, so it does not list language study as one of the circumstances. Q18 gives an embassy's answer on interviews and fingerprints, and it does not state the criteria the embassy uses to decide that an interview is necessary.
