Renewing a study residence permit: the 30-day rule

Under Article 32 of the Exit and Entry Administration Law, a foreigner residing in China who wants to extend the period of residence applies within 30 days before the residence permit expires. If the reasons for the extension are appropriate and sufficient, the extension shall be granted; if it is denied, the foreigner shall leave China on the expiry of the validity period specified in the residence permit.

When to apply

Article 32 of the Law sets the window as "within 30 days prior to the expiry of the validity period on their residence permits." The English service guide of the National Immigration Administration gives the same 30-day window in section 3, "Application for Extension or Change of Residence Permit."

Where to apply

Article 32 of the Law names the exit and entry administrations of public security organs under local people's governments at or above the county level. Section 3 of the English service guide names the exit and entry departments of public security organs under a local people's government at or above the county level "in the place of residence."

What to submit

Article 17 of the Regulations on Administration of the Entry and Exit of Foreigners (State Council Decree No. 637) lists four items for an application to extend, change or reissue a residence permit:

  • an application form;
  • the passport or other international travel documents;
  • qualified photos;
  • material relating to the purpose of the application.

Article 32 of the Law adds that the applicant submits "relevant information of specific application matters in accordance with relevant requirements."

If the procedures followed or the material submitted do not conform to the provisions, Article 18 of the Regulations says the authority shall, in a one-off manner, notify the applicant of the procedure(s) to be followed and the material to be supplemented and corrected.

Receipt of acceptance and time limit

Article 18 of the Regulations says that where an application meets the acceptance provisions, the authority issues a receipt of acceptance "valid for a period not exceeding 15 days," and decides on the application within the validity period of that receipt.

Article 18 also says that while the passport or other travel documents are retained for processing a residence permit application, the applicant may reside in China legally on the strength of the receipt of acceptance.

Section Ⅷ (Time Limit) of the English service guide says the validity of the acceptance receipt "shall not exceed 15 working days after the date of acceptance." Article 18 says 15 days, and section Ⅷ says 15 working days. This page does not decide between the two wordings.

If the extension is not granted

Article 32 of the Law says the foreigner "shall leave China on the expiry of the validity period specified in their residence permits."

Section 3 of the English service guide says that in case of a denial, "the foreigner shall leave China before the expiry of the residence certificate." The Law says "on the expiry" and the guide says "before the expiry." This page does not decide between the two wordings.

The Chinese service guide

The Chinese service guide for issuing, extending, replacing and reissuing foreigners' residence permits is a separate document from the English page. Its item (三), on extension and replacement, reads as follows in this site's English translation of the Chinese text: for an application to extend the period of residence or to change the registered items on a residence permit, the applicant submits the relevant certification materials, or the basic personal information and the certification materials for the change of residence purpose, in accordance with the clauses above; the period of residence "may" then be extended and the residence permit "may" be reissued.

Item (三) gives no application window. The 30-day window is stated in Article 32 of the Law and in section 3 of the English service guide.

Questions

Does Article 32 set a different window for students?

Article 32 of the Law refers to foreigners residing in China and names no student category. The window it sets is the 30 days before the expiry of the validity period on the residence permit.

Which time limit applies to the receipt of acceptance?

Article 18 of the Regulations gives "a period not exceeding 15 days." Section Ⅷ of the English service guide gives "15 working days after the date of acceptance." The two texts are worded differently.
