Extending a short course: what an X2 holder may apply for

An X2 holder who needs a longer stay files an extension application with the public security exit and entry administration in the place of stay, seven days before the stay in the visa expires. Article 29 of the Exit and Entry Administration Law sets that deadline and says the accumulated extension shall not exceed the original duration of stay in the visa. The National Immigration Administration's English service guide adds that, for X2 holders, the stay may be extended for no more than 180 days, and the holder shall submit a current study certificate.

What Article 29 of the Law provides

Article 29 of the Exit and Entry Administration Law (the Law) says:

  • Where the duration of stay in a visa does not exceed 180 days, the holder may stay in China within that duration.
  • Where the stay needs to be extended, the visa holder shall file an application seven days before the expiry of the duration specified in the visa.
  • The application shall give information on the specific matters, in accordance with relevant requirements.
  • If the reasons for extension are appropriate and sufficient, the extension shall be granted. If it is denied, the foreigner shall leave China on the expiry of the duration.
  • The accumulated length of extension shall not exceed the original duration of stay specified in the visa.

The X2 line of the two service guides

The National Immigration Administration publishes a service guide on visa extension in English and a separate guide in Chinese. The two are cited here as separate documents. The Chinese text is shown in this site's own English translation.

English guide, item j: a holder of an X2 visa shall submit a current study certificate issued by an education or training institution within the territory of China. The stay may be extended for no more than 180 days. The note under this item states that the accumulated extension of stay shall not exceed the original duration of stay specified in the visa.

Chinese guide, item 10: a holder of an X2 visa shall submit a certificate of current study (在读证明函件) issued by an education or training institution within China. The stay may be extended for no more than 180 days. The guide's next line states that the accumulated extension shall not exceed the original duration of stay specified in the visa.

The deadline and the Regulations

Item 2 of the English guide says that a foreigner applying to extend a stay shall apply to the exit and entry departments of public security organs seven days before the expiration date of the stay specified in the visa, and submit the supporting materials required. The Chinese guide gives the same seven-day deadline.

Article 14 of the Regulations on Administration of the Entry and Exit of Foreigners (State Council Decree No. 637, the Regulations) says:

  • A decision to extend the duration of stay is valid only for the current entry. It does not affect the number of entries or the validity period of the entry specified in the visa.
  • The total period of extension shall not exceed the original duration of stay specified in the visa.
  • A foreigner shall adhere to the purpose specified in the original visa and stay within the extended duration of stay.

Section VIII of the English guide

Section VIII of the English guide, headed "Time Limit for Issuance", covers visa applications. It says the decision on whether to issue a visa shall be made within the validity period of the acceptance receipt, and that the receipt's validity shall be no more than seven working days from the date of acceptance. Section VIII sets no time limit for extension decisions.

Questions

By when must an extension application be filed?

Seven days before the expiry of the duration of stay specified in the visa. Article 29 of the Law says so. Item 2 of the English guide and the seven-day line of the Chinese guide say the same.

Can the accumulated extension exceed the original stay in the visa?

The accumulated extension shall not exceed the original duration of stay specified in the visa. Article 29 of the Law and Article 14 of the Regulations both say this.
